The proposed contract for the above will be between £5,000 and £74,999.99.

I can also confirm that the contract terms which will be used for this contract will be the Council’s standard terms and conditions for goods and services or (where relevant) works or, where this is not the case, I have sought the approval of Legal Services to the alternative terms and conditions that I propose to use for this contract.

In accordance with the Council’s Contract Procedures Rules, three alternative quotes should be obtained and the lowest quotation should be accepted.

Obtaining three price quotes is not appropriate.
I can confirm that, despite non-compliance with the requirement to seek at least three quotes, the award of this contract to the above supplier will be best value for the Council for the following reason(s):
The Future High Street Fund project that is underway includes works to Barnstaple Pannier Market. As part of these works lead paint has been removed from timber trusses resulting in debris containing lead based paint. As a result the market has been shut. In order to re-open the market an environmental clean is required to remove the debris. A previous waiver has been approved for the environmental clean. This RFW is for additional works regarding the environmental clean identified subsequent to the first waiver. This RFW is to approve these additional works without obtaining further quotes. The reason for the request is to enable the additional works to be undertaken at the earlier possible opportunity to enable re-opening of the market. The waiver will avoid the delay of obtaining further quotes for the clean. Active Environmental Management are a reputable contractor experienced in this type of work. They have quoted £10,932.00 + Vat to carry out the additional works.
