To issue a Listed Building Enforcement Notice
under Section 38 of the Planning (Listed Buildings and Conservation
Areas) Act 1990 to require the removal of a balustrade and
staircase.
A Certificate of lawful use was refused on
11th January 2019 under application 65494. The building is a Grade
II listed building and Listed Building Consent is required to carry
out works. The creation of the balcony including the installation
of the balustrade and spiral staircase is considered unacceptable
as it adversely affects the amenity of the occupants of
neighbouring properties.
The owner of the land has previously failed to
remove the means for the balcony which includes the ballustrade and
staircase. The listed building enforcement notice is required to
remedy the alleged breach of planning control.
